Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

Human trafficking को ख़त्म करने के लिये एक app या online portal govt. को बनाना चाहिए , जिस पर कोई भी व्यक्ति अगर इस विषय से सम्बंधित कोई सुचना उसके पास हैं तो उस सूचना को सरकार तक पंहुचा सके, सूचना देने वाला व्यक्ति किसी photograph, या किसी txt msg के through दे सकता है, सुचना देने वाले व्यक्ति को 24 घण्टे के अंदर उस सुचना पर क्या action लिया गया है , उसे वो बताया जाये , जिससे की वो निश्चित रहे की जो काम मैं देश के लिए कर रहा हूँ सरकार भी उस काम में सहयोग कर रही हैं...

#Human Trafficking: 4. A special database of children living in villages near borders of states and transnational boundaries must be prepared and kept updated from time to time. 5. Counselling of rescued victim though a psychologist should be done and special care should be taken for his education and skill development. 6. Burden of proof in cases of human trafficking should be on the accused.

#Human Trafficking: The following provisions may be incorporated in the bill" 1. Human Trafficking cell/units should be established between borders of state and transnational boundaries. 2. Report of missing persons/children may be given through an app. 3. GPS in all trucks and other types of commercial vehicles including taxis and cab services be established in a phased manner and monitored in real time.

Nexus between the police and the criminals should be eradicated. A special task force with efficient and sincere police personnel should be formed with more power to punish the culprits. Government should be ruthless in dealing with Child-labour crimes. Rehabilitation for the victims should be effectively implemented with the help of Private organisations.

Prevention is vital An agency should be formulated in coordination with the ministries of women and child development and home affairs to keep vigil at railway stations and bus stands to detect suspects of trafficking young victims on the promise of jobs or marriage and also keeping watch on employment agents supplying domestic help Such agency be provided effective police support NGOs with proven credentials will also be a great help in prevention protection and rehabilitation

Trafficking of small children both boys and girls for sexual exploitation is the most heinous crime. In addition to tracing all lost children, there should be nation wide record of all the orphanages specially ones run by foreign funding and there should be strict check on visit to the orphanage by outsiders or export of children outside orphanage. Laws should be made for most severe punishment including imprisonment for whole life for those involved in trafficking or involved in sexual abuse.
