Ministry of Women and Child Development has formulated a draft Bill on “Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2016” for further consultations with all stakeholders. It aims to create a strong legal, economic and social environment against trafficking of persons and for matters connected therewith or incidental thereto.

The draft Bill has taken in to account the various aspects of trafficking and its punishments as defined in section 370- 373 of Indian Penal Code, 1860 and aims to include other offences/ provisions which are not dealt in any other law for the purpose of trafficking, such as (1) penal provisions for the disclosure of identity of the victim of trafficking and witness (2) use of narcotic drug or psychotropic substance or alcohol for the purpose of trafficking (3) use of chemical substance or hormones for the purpose of exploitation. The draft Bill has also taken in to its ambit the ‘placement agencies’ by making mandatory for them to also register for the purposes of this Act.

The proposed draft Bill aims to place dedicated institutional mechanism at District, State and Central level. It also envisages a designated Agency for the investigation of offences. It provides for Protection Homes and Special Homes for short term and long term rehabilitation support. For speedy trial with a view to increase prosecution and to reduce the trauma faced by the victims, the proposed draft Bill provides for establishing Special Courts in each district and experienced Special Prosecutors. Recovery of back wages and other monetary losses of the victim of trafficking is also proposed.

The draft Bill provides for mandatory reporting within 24 hours by a Police Officer, Public servant, any officer or employee of Protection Home or Special Home having custody of the victim of trafficking to the District Anti-Trafficking Committee or in case of child victim to the Child Welfare Committee. For the effective implementation of the proposed Act and for the welfare and rehabilitation of the victims an Anti- Trafficking Fund will be created.

mostly girls are vulnerable in trafficking. That's why there should be provision for rigurous punishment. There should be one 24*7 helpline.And parents also should be punished who involve for their profit.

Apart form registration of the agents and an online portal there should be provision of registering atleast 2 nos verified mobile numbers of the prospective job seekers and their nearest kin. On these numbers the govt of india can send automated information by sms alerting them where to contact in emergency, an alret of do's & Dont's etc.

Under the new law few points should be made compulsory: 1. Online disclosure by the agents / agencies etc to the Govt of India MoEA informing the names & other details of the prospective boys & girls 2. Registration of all the placement agents & agencies to be made compulsory those who are providing or helping get the jobs out of India. A registration number should be allotted to and linked to Aadhar / PAN / Certificate of incorporation etc.

Firstly, I don't think that there is a need of making another organization or putting any extra efforts to sort out this problem. If police, airport authorities and defence forces do their job with responsibility then Human trafficking is not possible at all. I have to say this that most of the time police is also involved in human trafficking and they too get their share from those criminals. First we need honest & educated people in politics. Then we need stricter laws against criminals.

Placement agencies for overseas placement must report the person details to the GOI and same must be tracked in embassies. Embassies must make people aware and establish helplines for citizens.

human trafficking is that type of crime that we cannot imagine the levrl of pain of the person with whom it happens. there should be only one punishment for guilty that is death. rape should also have only one decision that is death. i am student and i feel that this kind of strong law will let the criminals realize that indian law is not weak. other country's also jave such strong punishment that's why such kind of crime is less compare to india.

Link every person to AADHAR asap. Track movement of people through bio-metric system linked to AADHAR. Placement agencies must be made responsible to keep in contact with the person and get his/her half-yearly bio-metric scanned in government offices. Citizens to be made aware to check the license certificate of such agents/agencies. This act must be made more stringent and should cover child labor, forced labor, forced begging etc. Increase random surveillance by the anti-trafficking force.

"Trafficking" is a wide term. It should include "Kabootar bazi",-Bar girls,Prostitution-Callgirls-being agents-or Employers or even family members dragging or pushing into flashtrade -including drug trafficking-smuggling-using a child or woman or a human being practicing as beggar or pushed or used as beggar or any of the above mentioned activity.The punishment should be very very harsh.

There should be a provision in law that idientity of street children be ascertained by DNA test. Thus gangs can not claim the children as their offsprings.
