Ministry of Ports, Shipping and Waterways has circulated draft of Indian Ports Bill 2020 for public consultation which will repeal and replace the Indian Ports Act, 1908 (Act No. 15 of 1908)

The draft Indian Ports Bill, 2020, seeks to,inter alia, enable the structured growth and sustainable development of ports to attract investments in the Port sector for optimum utilisation of the Indian Coastline by effective administration and management of ports. The proposed Bill will provide measures to facilitate conservation of ports, taking into account the prevalent situation with respect to the high number of non-operational ports. It shall further ensure greater investment in the Indian maritime and ports sector through the creation of improved, comprehensive regulatory frameworks for the creation of new ports and management of existing ports.

The Bill also seeks to, inter alia, create an enabling environment for the growth and sustained development of the ports sector in India through the following broad methods:

1.Constitution of Maritime Port Regulatory Authority
2.Formulation of the National Port policy and National Port plan in consultation with Coastal State Governments, State Maritime Boards and other stakeholders.
3.Formulation of specialised Adjudicatory Tribunals namely Maritime Ports Tribunal and Maritime Ports Appellate Tribunal to curb any anti-competitive practises in the port sector and act as a speedy and affordable grievance redressal mechanism.

The up-to-date provisions of the proposed Bill would ensure safety, security, pollution control, performance standards and sustainability of Ports. The Bill ensures that all up-to-date conventions/protocols to which India is a party, are also suitably incorporated. This will promote marine safety and security in the true sense. The Bill will fill up the gapsfor achieving scientific development of Ports and Port Network.

The Bill seeks to provide increased opportunities for public and private investments in the Indian maritime and ports sector by way of removing barriers to entry, simplifying processes and establishment of agencies and bodies to plan and enable growth of the ports sector. Enhancing “Ease of Doing Business’,it will provide greater impetus to a self-reliant domestic investment climate in the maritime sector, towards AatmaNirbharBharat initiatives of the Government.

The draft of Indian Ports Bill 2020 is issued for public consultation for seeking the feedback and suggestions.

It will be tasked with advising the Centre and State governments on drafting and implementing a National Port Policy and Plan for sustainable port development, formulating short-term and perspective plans for the ports sector, regulate the functioning and practices of scheduled ports and co-ordinate the activities of planning agencies for optimal utilisation of the coastline, according to the Bill drafted by the Centre.

Formation of regulator Central to this idea is the formation of a Maritime Port Regulator Authority comprising a chairperson and two members, all full-time, nominated by the Centre and two part-time members nominated by coastal states.

The draft Bill will blur the distinction between major ports (owned by the Centre) and non-major ports (owned by the States) as private investors have been preferring the latter for putting their money due to lighter regulations and liberal terms, particularly on rates.

A ‘One Nation, One Port’ idea is slowly taking shape with the Centre drafting an Indian Ports Bill to replace the Indian Ports Act 1908 that will give it sweeping powers to “regulate and control” ports which are in the concurrent list of the Constitution. Coastal States, which have been aggressively pursuing development of ports under their jurisdiction, are expected to balk at the plan that will dilute their freedom over this key infrastructure sector, port industry sources said.

We believe MyGov is working with good intentions and is focused towards development. We also know that old laws have lost relevance in today's world. But, we have become so used to old systems that we are afraid of any change to these systems. Government shall discuss with different Unions, Legal Experts, Economists, Trade and Commerce bodies and bring them on board to generate consensus while formulating any new laws.

The bill should be reviewed & their correct implementation make it successful to show the path to other countries to trade with our country , The bills language is so simple that other partners not feel uneasy ness . New ports will be developed as the business opportunity are likely be increase by Atamanirbhar. General public interest may be added. Thanks

Don't know much about this topic! But my only suggestion as a citizen if this Nation is that any bill that the Government pass should not just focus on benefiting the Corporate world itself...Mahatama Gandhi is the father of nation and I believe he always would stood by what will promote India to developing state.
