The past few years have witnessed tremendous growth in data usage and quite a large number of data tariff offers are made available by the service providers. The regulatory guidelines till now on discrimination and transparency in tariff offers were more focused to address the regulatory concerns in voice telephony. The growth of data usage and the manner in which data schemes are being designed by service providers currently, calls for a re-look at the regulatory principles of non-discriminatory tariff and transparency measures in the context of data tariff offers.

It has come to the notice of TRAI that some service providers are offering differential data tariff with free or discounted tariffs to certain contents of certain websites/applications/platforms. The objective of offering such schemes is claimed to be the desire of various service providers/content providers or platform providers to enable the consumers, especially the poor, to access certain content on the internet free of charge.
Where reduced rates are tied to specific content, potentially, both positive and negative effects arise from an economic and regulatory perspective. On the one hand, it appears to make overall internet access more affordable by reducing costs of certain types of content. On the other hand, several negative effects might ensue. Differential tariffs results in classification of subscribers based on the content they want to access (those who want to access non-participating content will be charged at a higher rate than those who want to access participating content). This may potentially go against the principle of non-discriminatory tariff.
Therefore, the potential benefits and disadvantages of such practices have to be weighed in order to determine the regulatory approach.

In this background, TRAI has issued a consultation paper on the issue of differential pricing for data services seeking comments from stakeholders on certain issues as enumerated below:

i. Should the TSPs be allowed to have differential pricing for data usage for accessing different websites, applications or platforms?

ii. If differential pricing for data usage is permitted, what measures should be adopted to ensure that the principles of non-discrimination, transparency, affordable internet access, competition and market entry and innovation are addressed?

iii. Are there alternative methods/technologies/business models, other than differentiated tariff plans, available to achieve the objective of providing free internet access to the consumers? If yes, please suggest/describe these methods/technologies/business models. Also, describe the potential benefits and disadvantages associated with such methods/technologies/business models?

Through this forum of My Gov, TRAI invites the comments of the stakeholders on the above issues by 7th January, 2015.

I think we all should take time reading other comments here and up vote which are worth reading. That way, those trying to view different viewpoints from thousands (millions of message), can easily spot the important ones. Note that your opinion may match with someone else who has already posted. upvoting it makes sure that your thoughts are heard without the distraction of too many messages and without you having to type them and contributing to unnecessary comments.

Dear Sir, As we all said we don't want the free basics of the Facebook. We want Absolute Net Neutrality Mobile operator should not be allowed to charge more for data to companies then it charges to the user.

We do not want net neutrality to be in hands of telecom companies And I don't want telecoms to control what part of Internet I use n I do not want their control over my Internet access

No we don't want TSP's to be allowed. We are already paying too much for internet services. very few consumers use full data and companies are taking benefit. Internet and apps are free and everyone has right to use free services. Companies are charging too much from 2G plans and speed is very much slow. 3G plan are very expensive. govt. should not allow TSP's.

We don't want FB's free basics, the way it is now. Period. And, we want ABSOLUTE NET NEUTRALITY. Period. TSP may provide differential speeds for different packages. But at same time, there should not be a speed variation in same package for different services/sites #NetNeutrality

TSPs should not be allowed to charge deferentially. If differential pricing is allowed it should be for the benefit of user. The way to adopt differential pricing (zero rating) is 1. no change in data speed 2. all companies should be allowed to apply for it, internet.org or not 3. mobile operator should not be allowed to charge more for data to companies then it charges to the user. 4. User should not be asked to pay any kind of data/activation/other charge while he is using zero rated site.

1.Tariffs should simple. Tariff should be scalable according to the need of the user. 2.The present state of data service is extremely poor.Speed is far far lower with respect to the declared speeds.Reliability of the service is dimally poor. 3.If one compares the cost of data in India in relation to purchasing power of average Indian user - vis a vis to data charges in developed nations ( UK,USA,Korea,Japan etc.) in relation to their purchasing power,the cost here is very very high.

मै Net Neutrality का समर्थन करता हूँ । हम हिंदुस्तानियो को Facebook द्वारा दी जाने वाली Free Basic Internet Service नही चाहिए । और साथ मे सरकार कोई Gmail जैसा Email Service Provider शुरू करे सधन्यवाद.....।

We strongly support net neutrality, we dont need any gate keeper or walled garden in the name of FREE BASICS, to decide what to see or what not to see. We want to access all the websites on internet equally without any discrimination.
