Ministry of Electronics and IT has drafted a Data Centre policy to benefit the Data Centre park developers/Data Centre operators as well as the allied ecosystem of the Data Centre sector. The policy envisages making India a Global Data Centre hub, promote investment in the sector, propel digital economy growth, enable provisioning of trusted hosting infrastructure to fulfill the growing demand of the country and facilitate state of the art service delivery to citizens. This document lays out a policy framework including various structural / regulatory interventions, investment promotion in the sector, possible Incentivization mechanisms along with the institutional mechanism required for the governance. The policy framework also seeks to strengthen the recently announced “AatmaNirbhar Bharat” initiative by identifying possible opportunities of manufacturing of Data Centre equipment (IT as well as non-IT) in the country. It also identifies possible areas of participation by MSMEs and Start-ups.

The policy intends to ensure sustainable and trusted Data Centre capacity within the country. This policy framework shall be followed by a detailed scheme with implementation guideline document providing the particulars of various fiscal and non-fiscal incentives to be provided to the sector by the Central and State Government.

For the same, Ministry of Electronics and IT invites citizen suggestions on the Draft Data Center Policy 2020.

Government should be well informed about the databases it's security standards and use cases. the data and how it is being shared outside borders should be known to govt in advance. I request to strictly monitor the flow of sensitive data outside the country and organisations. we should have a PPP model to help startups standardize consult and establish strong interlinked secure DBs as per their need. foreign companies need to setup data centers here before serving indians.

If the operations are exempted under Factories Act, then it shall be covered under Shops and Establishment Act. Many Labour Laws will become applicable on data centers. Policy has to make it clear from the begining itself which clauses of a particular labour laws are applicable and which are exempted to avoid confusions and harassment at a later stage. As this being a new business, there will be lack of clarity about the operations and nature of business

How to address the security arrangements of these data centers shall be elaborated in this policy. Will it be responsibility of data center management or Government? Private security agency guards to be deployed or CISF shall be deployed as it happens with Airports. Even if the Airports are leased to private entities, being a national security matter, security is with CISF. Data centers shall also be covered with same security net as data security is also a national security issue

These data centers require a cool, green environmental conditions. So, where we plan to allocate big parcels of land? Hilly regions are eco sensitive zones and plains are dusty, land deficit zones. Availability of water also has to ensured. These data centers shall be planned in green field areas away from existing industrial estates and towns preferably along new highways being developed such as along under construction Delhi-Mumbai express way or KMP express way near IMT Manesar

There shall be some modifications in Factories Act also. As operations of many required facilities will be covered under the provisions of definition of being a Factory. But we understand that the core business is not manufacturing process. So, some exemptions would be needed in factories act and rules.

There is a provision in policy to add a separate code for data centers in National Building Code 2016. It shows that a lot of brain storming has been done in formulating the policy to include minute details.
